    Claims Management: Avoidance, Mitigation and Resolution

    Most major capital programs now experience some degree of disputes and the owner expects that the CM will support its goal to avoid, mitigate and resolve disputes and claims. This session focuses on construction management best practices regarding the avoidance (Pre-Construction/Construction phases), mitigation (Construction phase) and resolution (Construction/Post-Construction phases) of construction disputes and claims. Learn how to recognize and execute best management practices by the CM through all phases of the project which can impact the likelihood of the occurrence of claims. This session will introduce the CMAA Claims Management Guidelines which provides specific guidance through all phases of the construction project.

    About the Presenter

    Mr. Seibold has more than 40 years of experience and has served as a construction manager or provided expert testimony on a variety of public works projects such as healthcare facilities; public/institutional buildings; hotels, casinos / entertainment; airport facilities, highways, and bridges; ports; railways and transit; and water supply and wastewater treatment facilities. Mr. Seibold has provided expert testimony on behalf of owners, designers, contractors and construction managers including testimony regarding the standard of care for construction management practices. He has participated in all forums of dispute resolution including mediation, Dispute Review Boards, arbitration, mini?trials and litigation. In addition, Mr. Seibold has authored and presented numerous articles regarding construction management, as well as claims analysis and resolution. Mr. Seibold is the committee chairman responsible for the establishment and review of the Standards of Practice, Contract Administration, for professional construction management services as part of CMAA. In addition, Mr. Seibold is a Fellow and the past National President of CMAA.
